NYS DEC ISSUES CRISIS EXEMPTION FOR FOMASAFEN (REFLEX)
The New York State Department of Environmental Conservation,
(NYSDEC) the State lead agency for pesticide matters, has
issued a crisis exemption for the use in New York State.
This crisis exemption is effective 12:01 a.m. Monday,
July 5, 1993 and continues only so long as the infestation
continues, but in any event no longer than July 26, 1993.

from CENET.

(Difolatan) tolerances for captafol, including those for apples,
apricots, blueberries, cherries(sour and sweet), citrus
fruits, corn(fresh), cranberries, cucumbers, macadamia,
melons, nectarines, peanuts(hulls and meats), onions,
peaches, pineapples, plums(fresh prunes), potatoes,

captafol were canceled in 1987. The one remaining
intrastate registration was canceled in 1991. Written

(EDB) for ethylene dibromide resulting from its use as a
fumigant. Tolerances affected are for inorganic bromide
on or in asparagus, beans(lima), broccoli, carrots,
cauliflower, corn(sweet), corn(sweet)(forage),
cottonseed, cucumbers, eggplant, lettuce, melons, okra,
parsnips, peanuts, peanuts(hay), peanuts(hulls), peppers,
pineapples, potatoes, squash(summer), soybeans,
strawberries, sweet potatoes, and tomatoes; and ethylene
dibromide on or in barley, corn, corn(pop), mangoes oats,
rice, rye, sorghum(milo), soybeans, and wheat. most uses
of this soil fumigant were canceled in 1983; and all edb

linuron (Lorox) Du Pont has requested voluntary cancellation
of its 24(c) registrations in the State of
California for linuron on lupines and marigolds
due to the cost of reregistration. This action
will become final on 7/6/93 unless the
registrant withdraws the request. Existing
stocks in the hands of dealers and users can be
sold and used until they are exhausted.

methazole On February 5 of this year, we reported here that
(Probe) existing stocks of methazole, a recently canceled
herbicide used on cotton, may become available in
marketing channels if ongoing studies showed an
acceptable level of exposure risk. Those studies are
now complete, show an acceptable level of exposure
risk and have resulted in an amendment to the
cancellation order. Consequently, conditioned on
supplemental labeling, existing stocks may be
distributed, sold and used from May 20 to December 31
of 1993.

The following uses of malathion are currently unsupported and
expected to be canceled due to the cost of reregistration.
Current EPA policy allows unsupported uses to remain on labels
until the last study due date for that chemical. The due date for
the last study on malathion is December of 1995. Uses may be
removed from labels before that time, but the following uses may
not be on labels of malathion products sold by the registrants to
retailers starting in January of 1996. Existing stocks in the
hands of retailers and users may be used as labeled until
exhausted.

Revocation of Food Additive Regulations for Benomyl, Mancozeb,
Phosmet, and Trifluralin
EPA is revoking certain food additive regulations
for four pesticides which were included in a 1989 petition.
The U.S. Court of Appeals, Ninth Circuit, has set aside the
Agency's original order denying the petition for revocation
of the food additive regulations at issue in this revised Order;
accordingly, EPA is granting the petition request to revoke
these food additive regulations.
EFFECTIVE DATE: This regulation becomes effective August 30, 1993.
In this revised Order, EPA is implementing a decision by
the U.S. Court of Appeals, Ninth Circuit, Les v. Reilly, 968
F. 2d 985 (9th Cir. 1992), cert. denied, 113 S. Ct. 1361 (1993),
which set aside a previous EPA Order denying a petition to revoke
the following food additive regulations: trifluralin (spearmint
oil and peppermint oil), benomyl (raisins and processed tomato
products), phosmet (cottonseed oil), and mancozeb (raisins and
bran of wheat). The petition asserted that these food additive
regulations violated the Delaney Clause in section 409 of the
Federal Food, Drug, and Cosmetic Act. EPA declined to revoke
several of these food additive regulations based on EPA's view
that the Delaney Clause is subject to a de minimis exception
and that the risks posed by dietary exposure to the pesticide
residues at issue are trivial.

Bufencarb (Bux); Revocation of Tolerances
This document revokes the tolerances listed in 40 CFR
180.255 for residues of the insecticide bufencarb (a mixture
consisting of 25 percent 3-(1-ethylpropyl) phenyl methylcarbamate
and 75 percent 3-(1-methylbutyl) phenyl methylcarbamate) in
or on the following raw agricultural commodities: corn fodder,
corn forage, fresh corn (including sweet corn kernels plus cob
with husk removed (K+CWHR)), corn grain, rice grain, and rice
straw. EPA is taking this action because all registered uses
of bufencarb on these commodities have been canceled.

Crufomate (Ruelene); Revocation of Tolerances
This document revokes the tolerances listed in 40 CFR
180.295 for residues of the insecticide crufomate (2-chloro-
4-(1,1-dimethylethyl)phenylmethyl methyl-phosphoramidate) and
its metabolite 2-chloro-4-(1,1-dimenthylethyl)phenol in or on
fat, meat, and meat byproducts of cattle, goats, and sheep.
EPA initiated this action because all registered uses of crufomate
on these livestock animals have been canceled.

Boric Acid and its Salts, Borax (Sodium Borate Decahydrate),
Disodium Octaborate Tetrahydrate, Boric Oxide (Boric Anhydride),
Sodium Borate and Sodium Metaborate; Tolerance Exemptions
This document proposes that an exemption from the requirement
of a tolerance be established for residues of boric acid and
its salts, borax (sodium borate decahydrate), disodium octaborate
tetrahydrate, boric oxide (boric anhydride), sodium borate,
and sodium metaborate, in or on raw agricultural commodities
when used as an active ingredient in insecticides, herbicides,
or fungicides preharvest or postharvest in accordance with good
agricultural practices. This proposed regulation was requested

exemption would supersede the tolerances for boron established

Pesticide Tolerance for Cyromazine (Trigard)
EPA proposes to establish a tolerance for residues
of the insect growth regulator cyromazine (N-cyclo-propyl-1,3,5-

(1,3,5-triazine-2,4,6-triamine), calculated as cyromazine, in
or on mushrooms at 10.0 parts per million (ppm). This regulation

EPA has received from AgriVirion Inc., of New York,
a notification of intent to conduct a small-scale field test
involving the genetically-altered (polyhedron-minus) Autographa
californica nuclear polyhedrosis virus (AcNPV). AgriVirion intends
to test the pesticide on cabbage in New York. The target pest
for these field trials is cabbage looper.

Pesticide Tolerances and Food Additive Regulation for Glyphosate (Roundup)
This document establishes tolerances and a food additive
regulation for residues of the herbicide glyphosate [(N-phosphonomethyl)
glycine] in or on the raw agricultural commodities (RACs) wheat
at 5.0 parts per million (ppm), wheat straw at 85 ppm, the tree
nut crop group at 1.0 ppm, almond hulls at 25 ppm, and a food
additive regulation for wheat milling fractions (except flour)
at 20 ppm. Monsanto Co. submitted petitions requesting EPA to
establish the maximum permissible residues of the herbicide
in or on these RACs and the processed human food.

Pesticide Tolerance and Food Additive Regulation for Hexakis
[2-Methyl-2-Phenylpropyl] Distannoxane
This document proposes that a pesticide tolerance be
established for residues of the pesticide hexakis in or on the
raw agricultural commodity marigolds and that a food additive
regulation be established for the processed feed commodities
dried marigolds and marigold extract. The proposed regulations
to establish maximum permissible levels for residues of the
pesticide in or on the commodities were requested in petitions
submitted by the Interregional Research Project No. 4 (IR-4).
Marigolds are fed to poultry in the form of dried and ground
flower petals or as an extract of xanthophyll concentrate produced
from marigold petals. Xanthophylls are plant pigments which
are fed to poultry to increase yellow pigment and enhance the
yellow color of their egg yolks and skin.

Issuance of an Experimental Use Permit for Four Transgenic Plant
Pesticides
On April 29, 1993, EPA issued an Experimental Use Permit
(EUP) to Monsanto Company to conduct field testing of four transgenic
plant pesticides. Monsanto is testing the Colorado Potato
Beetle (CPB) control protein, delta-endotoxin, derived from
the soil microbe Bacillus thuringiensis subspecies tenebrionis
(B.t.t.), as expressed in plants and tubers of several lines
of potato cultivars. According to the application, CPB control
protein, B.t.t. delta-endotoxin, will be present at no more
than .2 percent of the total weight of the potato plants or
tubers.
Monsanto's test sites are located in the following 13 States:
Colorado, Idaho, Maine, Maryland, Michigan, Montana, New York,
North Dakota, Ohio, Oregon, Pennsylvania, Washington and Wisconsin.
A maximum of 15,000 plants or tubers will be planted per acre,
each weighing approximately 5.6 grams per plant and 60 grams
per tuber. Some of the potato cultivar lines will contain only
the B.t.t. gene for mediating CPB resistance. Other potato cultivar
lines have been modified to contain genes mediating both CPB
and PYV or PLRV resistance. The total plant material, at planting,
will contain 129.31 grams B.t.t. protein, with levels rising
to a maximum of 39.4 kilograms of B.t.t. protein at harvest.
Likewise, the amount of viral coat protein, at planting, will
be approximately 0.005 grams of PLRV coat protein and 0.10 grams
of PVY coat protein; how much would be present at harvest is
not known, however, for the viral coat proteins.

Pesticide Tolerance for 4-(Dichloroacetyl)-1-Oxa-4-Azaspiro[4.5]Decane
This document establishes a time-limited tolerance
for residues of 4-(dichloroacetyl)-1-oxa-4-azaspiro[4.5]decane
(CAS Reg. No. 71526-07-3) in pesticide formulations applied
to corn fields before the corn plants emerge from the soil with
a maximum use level of 0.4 pound of 4-(dichloroacetyl)-1-oxa-
4-azaspiro[4.5] decane per acre at a level of 0.005 ppm in or
on corn. This regulation to establish a maximum permissible
level for residues of the inert ingredient in or on the commodity
was requested by the Monsanto Co. This time-limited tolerance
expires on January 31, 1998.
