WORKER PROTECTION STANDARD IMPLEMENTATION
-How to Comply Manual
The EPA is preparing a complete manual on the WPS for agricultural
employers: "The Worker Protection Standard for Agricultural Pesticides --
How To Comply." The manual will be completed in April 1993 so that
printing can begin in May. The manual will be printed by EPA, the
Government Printing Office (GPO), and a number of private printers.
The Cooperative Extension Service will make the manual available to State
and county offices. The National Agricultural Chemicals Association
and the Agricultural Retailers Association also have expressed interest
in printing. EPA will be compiling information on the various sources
of the How To Comply Manual. The following information also is being

-Pesticide Registration (PR) Notice. On April 20, EPA issued the
pesticide registration (PR) notice to registrants of agricultural
pesticide products. Issuance of this notice begins the process of modifying
pesticide product labels to meet the new WPS labeling requirements. Over
8,000 agricultural product labels will be revised. The revised labels will
include (1) specific WPS requirements which are detailed on the product label
and (2) a statement referencing the WPS and requiring product users to comply
with the WPS general provisions.

EPA, FDA, AND USDA ANNOUNCE POLICY CONCERNING EMERGENCY USE OF PESTICIDES
AFFECTED BY COURT DECISION ON DELANEY CLAUSE
On Friday, May 7, EPA announced a new policy on emergency exemption,
based on the U.S. Ninth Circuit Court of Appeals' interpretation of the
Delaney Clause. The announcement lists revocations of current exemptions
and denials of requests.
The U.S. Environmental Protection Agency, the Food and Drug Administration,
and the U.S. Department of Agriculture today jointly announced that emergency
exemptions will no longer be allowed for uses of certain pesticides on crops.
The announcement is the result of the U.S. Ninth Circuit Court of Appeals'
interpretation of the Delaney clause of the Federal Food, Drug and Cosmetic
Act (FFDCA). Each year, EPA is asked by federal and state agencies to grant
exemption s, which permit emergency use of pesticides on specific crops for
which the pesticides are not approved or registered.
The court ruled (Les Vs Reilly) that under the Delaney clause EPA "has no
discretion" to establish pesticide tolerances that allow pesticide residues
to be present in processed foods at levels greater than in raw foods if the
pesticide "induces cancer in animals," regardless of how small the risk.
Applying the Court's decision, EPA today revoked five emergency exemptions it
had granted previously band denied requests for another 16.
"We continue to believe that the pesticides affected by the Court decision,
including those EPA is acting on today, pose only a negligible risk to public
health," said Carol Browner, EPA Administrator. "However the decision leaves
us little choice but to deny emergency exemptions to pesticides that would be
covered by the Delaney clause."
This new policy is a joint initiative of EPA and the Food and Drug
Administration, which is responsible for enforcing the FFDCA provisions
regarding the presence of pesticide residues in food. The United States
Department of Agriculture has also shared in the development of this policy.
"The necessity of this new policy highlights the need for new legislation
that addresses food safety. The Clinton Administration will work with
Congress and other interested parties to develop a proposal. The proposal
must reflect sound public policy and science and strengthen the current law
for regulating pesticides and their residues. Most important, any
legislative package must assure overall safety of the food supply," Browner
maintained.
The new policy is expected to affect only a small proportion of the
approximately 300 emergency exemptions EPA allows each year. In cases where
emergency uses have been denied or revoked because of the Delaney clause, EPA
will make efforts to reduce the resulting hardships on growers by expediting
emergency requests for alternative products. Although there are alternative
pesticide products for many of the pesticides affected by the new policy,
some growers may find themselves without suitable alternatives to meet
emergency needs.
Under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), EPA is
authorized to permit the limited use of pesticides in emergency situations on
crops for which such pesticides are not registered and for which appropriate
raw or processed food tolerances are not established under FFDCA (Most of the
pesticides used under emergency conditions are products that are registered
for use on other crops for which appropriate tolerances have been
established).
Historically, when EPA determines that an emergency exemption is appropriate,
the Agency evaluates the residue level in terms of protecting public health
and then advises FDA of the expected residue level. FDA has generally
exercised enforcement discretion and has not taken action against foods or
animal feed containing residues within expected residue levels identified by
EPA for an approved emergency use of a pesticide. For emergency exemptions
which are revoked as a result of this policy, FDA plans to continue the
current discretionary practice of allowing foods treated prior to revocation
of the emergency exemption to remain in commerce.
EPA is adopting this policy before completing review of comments received in
response to its Feb. 5 notice requesting comments on this issue and others
affected by the court decision on the Delaney clause. The urgency of taking
action now is prompted by the pending applications for the emergency use of
certain pesticides which would be prohibited under the policy being
announced. Ultimately, EPA will consider all comments received as it
determines whether the policy being announced is appropriate.
In the recent Les vs Reilly decision, the court held that the Delaney clause
in FFDCA barred the establishment of tolerances for pesticides in processed
food for any pesticide that meets the "induce cancer in animals" standard, no
matter how infinitesimal the risk. The court overturned EPA's interpretation
that the Delaney clause allows pesticide uses which pose a de minimis risk.
Although that decision was handed down on July 8, 1992, because of appeals,
it did not become effective until March 19, 1993.

Videoconference on NAS Pesticide Report
The long-awaited National Academy of Sciences report on
Pesticides in the Diets of Infants and Children is scheduled to
be released at a news conference in Washington D.C. at 11:00 a.m.
on June 29. To coincide with the release of the report, Cornell
will be sponsoring a national satellite videoconference for
journalists, state specialists, county extension agents and
others interested in the report. The videoconference is scheduled
for June 29 from 12 Noon to 3:00 p.m. Eastern time. Counties
interested in this conference should be reserving the time for
the satellite downlink.
The conference will give reporters and others an opportunity to
address questions to nationally recognized toxicologists, food
safety specialists and others to help them understand this
important report, and to prepare local stories using the
resources of the Cooperative Extension System. The conference
will be appropriate for either statewide organized workshops for
journalists and others or for individual counties with downlink
capabilities to involve local journalists in viewing and
participating in the question call-in/fax session.
In the next Alert (to be mailed June 9), I will be enclosing a
copy of the letter describing the purpose of the videoconference
that went to extension food safety specialists nationwide and a
proposed agenda for the videoconference. I also hope to enclose a
set of materials for use in recruiting reporters and others to
your site. If available in time for mailing, you will also find a
set of the reference materials which can be duplicated for
participants.

Two Genetically Modified Potato Products to be Tested Under an Experimental
Use Permit in New York State
The New York State Department of Environmental Conservation
has approved registration of the following experimental products
genetically modified to be resistant to the Colorado Potato
Beetle pursuant to the referenced EUP:
-Insect resistant potato plants and tubers containing a
Bacillus thurinqiensis subsp. tenebrionis protein; and
-Insect resistant potato plants containing a Bacillus
thurinqiensis subsp. tenebrionis protein and the coat
protein of Potato Leaf Roll Virus.
The accepted experimental program for New York State is as
outlined and approved by the U.S. Environmental Protection
Agency. Modifications to Monsanto's Experimental Protocol which
are specified in the EPA approved permit must be observed for the
program in New York State.

Receipt of Notification of Intent to Conduct Small-Scale Field
Testing; Nonindigenous and Genetically Modified Microbial Pesticide in New
York State
The EPA has received from the Department of Plant Pathology,
Cornell University, a notification of intent to conduct small-scale field
testing in New York with three nonindigenous strains and two genetically
modified strains of Erwinia herbicola.
A notification of intent to conduct small-scale field testing pursuant to the
EPA's ``Statement of Policy; Microbial Products Subject to the Federal
Insecticide, Fungicide, and Rodenticide Act and the Toxic Substances Control
Act'' of June 26, 1986 (51 FR 23313), dated May 4, 1993, has been received
from the Department of Plant Pathology, Cornell University, Ithaca, New York
14853. The purpose of the proposed testing is to evaluate the efficacy of
three nonindigenous strains and two genetically modified strains of Erwinia
herbicola for the control of fire blight in apples. The nonindigenous strains
were isolated from fruit trees in Israel. The genetically modified strains
were produced from two indigenous strains of Erwinia herbicola by transposon
mutagenesis with the transposon Tn5. The proposed field tests would be
conducted in the State of New York on a total area of less than 10 acres.

Registration of NOVA 40W Agricultural Fungicide
(EPA Req. No. 707-221) in New York State
The New York State Department of Environmental Conservation
(NYSDEC) has approved an application to register the referenced
product for use as a fungicide for ground application on apples,
grapes, and stone fruits (cherries, peaches and nectarines) in
New York State.
The active ingredient Myclobutanil was formerly registered
in New York State for use on apple and grape crops. Since the
application rates for stone fruits are lower than the currently
approved rates for apples, the new usage is not considered a
major change in labeling.
The Department is pursuing the development
of a comprehensive groundwater monitoring program to track
products demonstrating a potential to leach to groundwater.
Myclobutanil is such a product. Until such time as the
Department is in a position to initiate this program,
Rohm and Haas will be required to sample certain wells for the 1993 and 1994
growing season.

Exemption From the Requirement of a Pesticide Tolerance for the Microbial Pest
Control Agent Metarhizium Anisopliae Strain ESF1
EPA is establishing food and feed additive regulations
as well as an exemption from the requirement of a pesticide
tolerance on all raw agricultural commodities regarding the
use of the microbial pest control agent Metarhizium anisopliae
strain ESF1 in food-handling establishments, feed-handling establishments,
and greenhouses in accordance with certain prescribed conditions. The
material is used to control cockroaches. EcoScience Corp. requested this
regulation.

Fenoxaprop-ethyl; Extension of A Temporary Tolerance
The EPA has extended a temporary tolerance for the combined
residues of the herbicide fenoxaprop-ethyl and its metabolites
in or on the raw agricultural commodity barley, grain at 0.05
part per million (ppm). This temporary tolerance expires April 10, 1994.
This tolerance was issued in response to pesticide petition (PP)
1G3927, submitted by Hoechst Celanese Corporation, Route 202-
205, P.O. Box 2500, Somerville, NJ 08876-1258.
This temporary tolerance has been extended to permit the
continued marketing of the raw agricultural commodity named
above when treated in accordance with the provisions of experimental
use permit 8340-EUP-13, which is being extended under the Federal
Insecticide, Fungicide, and Rodenticide Act (FIFRA) as amended
(Pub. L. 95-396, 92 Stat. 819; 7 U.S.C. 136).

Request for Comment on Petition To Revoke Certain Food Additive
Regulations for Benomyl and Mancozeb
This document announces the receipt of and solicits
comment on two petitions proposing the revocation of certain
section 409 food additive tolerances under the Federal Food,
Drug and Cosmetic Act (FFDCA). This notice sets forth the basis
for the petitioners' proposal and provides opportunity for comment
by the public. Written comments, identified by the document control
number, [OPP-300285], must be received on or before June 18,
1993. Comments should be forwarded to Public Response and Program
Resources Branch, Field Operations Division (H7506C), Office
of Pesticide Programs, 401 M St., SW., Washington, DC 20460.
EPA has received petitions from E.I. du Pont de Nemours &
Co. and the Mancozeb Task Force requesting revocation of certain
food additive regulations. The petitioners claim that no section
409 tolerances are necessary for these uses because the residues
do not concentrate during processing. EPA announces the receipt
of and solicits comment on these two petitions. EPA especially
requests comment on the request to revoke the mancozeb tolerances
for various flours because the rationale stated in the petition
(that residues decrease during processing) was the reason these
tolerances were set at a lower level than the section 408 tolerances.
It should be noted that there is currently another petition
before EPA requesting the revocation of the benomyl food additive
tolerance for concentrated tomato products and the mancozeb
food additive tolerances on raisins and bran of wheat. The petition
asserts that these food additive tolerances should be revoked
because of the Delaney anti-cancer clause in section 409. EPA's
earlier order denying that petition as to these tolerances was
set aside by the U.S. Court of Appeals, Ninth Circuit, in Les
v. Reilly, 968 F. 2d 985 (9th Cir. 1992).
Pursuant to 40 CFR 177.125 and 177.30, EPA may issue an order
ruling on the petition or may issue a proposal in response to
the petition and seek further comment. If EPA issues an order
in response to the petition, a person adversely affected by
the order may file written objections and a request for a hearing
on those objections with EPA on or before the 30th day after
date of the publication of the order. 40 CFR 178.20.

Pesticide Tolerances for Imazalil (Fungaflor)
This rule amends existing tolerances and establishes
new tolerances for residues of the fungicide imazalil and its
metabolite in or on various raw agricultural commodities. The
regulation was requested by Janssen Pharmaceutica and establishes
the maximum permissible level for residues of the fungicide
in or on the raw agricultural commodities.

Pesticide Tolerances for Metalaxyl (Ridomil) Established
This document establishes tolerances for combined residues
of the fungicide metalaxyl and its metabolites in or on grapes
at 2.0 parts per million (ppm), wet and dry grape pomace at
10.0 ppm, raisins at 6.0 ppm, and raisin waste at 10.0 ppm.
This regulation to establish the maximum permissible levels
for residues of metalaxyl in or on the commodities was requested
in petitions submitted by the Ciba-Geigy Corp.

Receipt of Notification of Intent to Conduct Small-Scale Field
Testing; Genetically Modified Microbial Pesticide
The EPA has received from the Ciba-Geigy Corp. a notification
of intent to conduct small-scale field testing on cotton, vegetables,
and ornamentals in Florida, Mississippi, California, New York,
and Illinois of a genetically modified strain of Pseudomonas
fluorescens isolated from roots of cotton plants grown in Texas.
The purpose of the proposed testing is to evaluate the efficacy of a
genetically modified strain (CGA-267356) of an indigenous strain of
Pseudomonas fluorescens, strain MOCG-0134, isolated from roots of cotton
plants grown in Texas, for the control of soil-borne pathogens of cotton,
vegetables, and ornamentals. The proposed field tests would be conducted at
Ciba-Geigy research stations in Florida, Mississippi, California, New York,
and Illinois. The total area of the proposed test sites is 1.5 acres.

Methazole; Amendment of Cancellation Order
AGENCY: Environmental Protection Agency (EPA).
This notice announces the Agency's decision to amend
the cancellation order of January 13, 1993, to allow the conditional
distribution, sale and use of all remaining stocks of methazole
(2-(3,4-dichlorophenyl)-4-methyl-1,2,4-oxadiazolidine-3,5-dione).
The restriction of distribution, sale, and use of existing
stocks is removed effective May 20, 1993. Distribution, sale,
and use of existing stocks will be permitted until December
31, 1993.

The EPA has received notices of registration of pesticides
to meet special local needs under section 24(c) of the Federal
Insecticide, Fungicide, and Rodenticide Act (FIFRA), as amended,
from 34 States. A registration issued under this section of
FIFRA shall not be effective for more than 90 days if the Administrator
disapproves the registration or finds it to be invalid within
that period. If the Administrator disapproves a registration
or finds it to be invalid after 90 days, a notice giving that
information will be published in the Federal Register.

PESTICIDE REGISTRATION CANCELLATIONS AND AMENDMENTS
1. Notice of Receipt of Requests for Amendments To Delete Uses in Certain
Pesticide Registrations
EPA is issuing a notice of receipt of request for amendment by registrants to
delete uses in certain pesticide registrations. Unless a request is withdrawn,
the Agency will approve these use deletions and the deletions will become
effective on August 17, 1993.
Users of these products who desire continued use on
crops or sites being deleted should contact the applicable registrant
before August 17, 1993 to discuss withdrawal of the applications
for amendment. This 90-day period will also permit interested
members of the public to intercede with registrants prior to
the Agency approval of the deletion.

Provisions for Disposition of Existing Stocks
The effective date of cancellation will be the date of the
cancellation order. The orders effecting these requested cancellations
will generally permit a registrant to sell or distribute existing
stocks for 1-year after the date the cancellation request was
received. Unless the provisions of an earlier order apply, existing
stocks already in the hands of dealers or users can be distributed,
sold or used legally until they are exhausted, provided that
such further sale and use comply with the EPA-approved label
and labeling of the affected product(s). Exceptions to these
general rules will be made in specific cases when more stringent
restrictions on sale, distribution, or use of the products or
their ingredients have already been imposed, as in Special Review
actions, or where the Agency has identified significant potential
risk concerns associated with a particular chemical.

3. Notice of Receipt of Requests for Amendments To Delete Uses in Certain
Pesticide Registrations
The EPA is issuing a notice of receipt of request for amendment by registrants
to delete uses in certain pesticide registrations. Unless a request is
withdrawn, the Agency will approve these use deletions and the deletions will
become effective on August 31, 1993.

Existing Stocks Provisions
The Agency has authorized registrants to sell or distribute
product under the previously approved labeling for a period
of 18 months after approval of the revision, unless other restrictions
have been imposed, as in special review actions.

Registrations
The EPA is issuing a notice of receipt of requests by registrants to
voluntarily cancel certain pesticide registrations. Unless a request is

Loss of Active Ingredients
Unless these requests for cancellation are withdrawn, six
pesticide active ingredients will no longer appear in any registered
products. Those who are concerned about the potential loss of
these active ingredients for pesticidal use are encouraged to
work directly with the registrants to explore the possibility
of their withdrawing the request for cancellation. These active
ingredients are listed in the following Table 9 with the EPA
Company Number of their registrants:
