FIFRA EMERGENCY EXEMPTION (SECTION 18) REQUESTS FOR NEW YORK STATE
Requests for 1995 pesticide emergency exemptions (section 18s) should be
submitted to the Pesticide Management Education Program (PMEP) as soon as
possible. Requests should be submitted at least 120 days in advance of the
proposed pesticide application (initial). Please contact PMEP directly
before assembling the necessary/required documentation.

PMEP TO SURVEY CORN GROWERS FOR USDA's PESTICIDE IMPACT ASSESSMENT
PROGRAM
The Pesticide Management Education Program (PMEP) will survey corn growers
in New York State for pesticide assessment/use during the fall and winter
as part of our Pesticide Impact Assessment responsibility for USDA. The
program will assess what pesticides are being used, pest problems
associated with pesticide use (or lack of pesticide use), chemical
alternatives to pest problems, and worker protection needs including
protective clothing. Pesticide recertification credits will be offered.

EPA FORMS NEW UNIT TO ENSURE CONSISTENT, HIGH QUALITY LABELS ON
PESTICIDE PRODUCTS
The Office of Pesticide Programs (OPP) has established a Labeling Unit
within the Registration Division to provide a centralized program for
identifying, addressing and resolving generic labeling issues. The goal of
the new unit is to ensure that the labels on pesticide products are clear,
technically accurate and consistent. The new unit will focus on labeling,
label audit and evaluation, and label policy development. Pesticide labels
are the primary tool for informing the public of the risk, hazards, and
proper use of pesticides. Over time, and often due to numerous changes,
labels have become confusing, cluttered and sometimes inconsistent.
Inquiries about generic labeling policy or procedural issues can be
directed to the Labeling Unit at 703/308-8641. Inquiries about specific
product labels should be directed to the product manager responsible for
the pesticide product.

PUBLIC INVOLVEMENT IN SIGNIFICANT RISK REDUCTION DECISIONS ON
REGISTERED PESTICIDES
This EPA notice describes the Agency's general policy to provide
opportunities for public involvement before reaching final significant risk
reduction decisions on registered pesticides. Through this notice, the
Agency is soliciting comments and suggestions from interested parties
concerning the mechanisms used for public involvement prior to the Agency
reaching such decisions, particularly those reached through the Special
Review process and negotiated settlement agreements.
Under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), EPA
is given the responsibility of regulating the manufacture, sale, and use of
pesticides to ensure that there are no unreasonable adverse effects to
human health or the environment as a result of the use of a pesticide.
Regulatory decisions that carry out this responsibility are reached by
evaluating the risks and benefits associated with the pesticide's use, as
well as with alternative pesticides and pest control methods.
This process determines what degree of risk is reasonable while taking into
consideration the economic and social benefits gained from the pesticide,
ensuring that the risks do not outweigh the benefits. The Agency has
several mechanisms in place to effect this balance if the results of the
risk and benefit evaluations indicate that unreasonable adverse effects are
likely from the pesticide's use and that regulatory action is warranted.
Each of these mechanisms has advantages and disadvantages that range from
the length of time required to reach the regulatory decision, the amount of
Agency resources necessary, to the degree the public is involved.

PET PESTICIDE PRODUCT LABEL STATEMENTS; NOTICE OF AVAILABILITY AND
REQUEST FOR COMMENTS
EPA is soliciting comments on proposed label statements for pesticide
products registered for use on dogs and/or cats. The statements have been
developedin a draft Pesticide Regulation (PR) Notice entitled, "Pet
Pesticide Product Label Statements" which is available upon request.
The PR Notice specifies statements that should be added to the labels of
pesticide products which are registered for use on dogs and/or cats. The
label statements outlined in the notice will help to ensure that products
are used safely and risk of adverse effects to pets and humans is reduced.

STATEMENT OF POLICY FOR PESTICIDE PRODUCTS USED TOGETHER OR
SEQUENTIALLY; NOTICE OF AVAILABILITY AND REQUEST FOR COMMENTS
EPA is soliciting comments on a proposed policy for labeling of pesticide
products used together or sequentially. That policy has been developed in
a draft Pesticide Regulation (PR) Notice entitled, "Labeling Limitations
for Products Used Together or Sequentially" which is available upon
request.
Pesticide products may be mixed or used after other pesticides according to
label directions. However, sometimes products bear labeling statements
which prohibit or advise against using certain products together or after
each other to prevent crop phytotoxicity, incompatibility, reduction of
efficacy or adverse effects to humans or the environment. The Agency is
proposing guidance on when such labeling statements will be approved. The
proposed policy is that the Agency will require or approve mandatory
labeling statements prohibiting or limiting use of one product with or
after another only if data are submitted which demonstrate that
unreasonable adverse effects will occur without such statements. If EPA is
not persuaded by the data or no data are submitted, the Agency will approve
advisory statements which recommend that a product not be used with or
after another.

LAND DISPOSAL RESTRICTIONS PHASE II-UNIVERSAL TREATMENT STANDARDS, AND
TREATMENT STANDARDS FOR ORGANIC TOXICITY CHARACTERISTIC WASTES AND NEWLY
LISTED WASTES
As part of the Agency's Land Disposal Restrictions (LDR) program, EPA has
promulgated treatment standards for the newly identified organic toxicity
characteristic (TC) wastes (except those managed in Clean Water Act (CWA)
systems, CWA- equivalent systems, or Class I Safe Drinking Water Act (SDWA)
injection wells), and for all newly listed coke by-product and
chlorotoluene production wastes. The required treatment standards for
these wastes must be met before they are land disposed. Promulgation of
these treatment standards for the newly identified and listed wastes and
promulgation of the dilution prohibitions for high TOC ignitables and
pesticides fulfills requirements of a proposed consent decree between EPA
and the Environmental Defense Fund, and a settlement agreement between EPA,
the Hazardous Waste Treatment Council, and a number of environmental groups
including the Natural Resources Defense Council.
EPA is also making a major improvement in the Land Disposal Restrictions
program in order to simplify and provide consistency in the requirements.
EPA is establishing a single set of requirements, referred to as universal
treatment standards, that apply to most hazardous wastes. EPA is also
simplifying the Land Disposal Restrictions program by reducing paperwork
for the regulated community, and improving guidance to make compliance
easier. EPA is also publishing clarifying guidance regarding treatability
variances, which largely restates previous Agency statements. Finally, EPA
is modifying the hazardous waste recycling regulations which will allow
streamlined regulatory decisions to be made regarding the regulation of
certain types of recycling activities.
The final rule is effective on December 19, 1994.

BIFENTHRIN (TALSTAR, BRIGADE) TOLERANCES AND EXTENSION OF TOLERANCES
This rule establishes time-limited tolerances (with an expiration date of
November 15, 1997) for residues of the synthetic pyrethroid bifenthrin in
or on the raw agricultural commodities (RACs) corn (field, seed, and pop)
grain, silage (forage), stover (fodder); milk, milk fat; meat, fat, and
meat byproducts of cattle, goats, hogs, horses, sheep, and poultry; and
eggs. FMC Corp. petitioned EPA to establish maximum permissible levels for
residues of the pesticide in or on the commodities.

TETRACHLORVINPHOS, TERBUTRYN, AND ETRIDIAZOLE; PROPOSED REMOVAL OF
TOLERANCES
This document proposes to remove tolerances for residues of
tetrachlorvinphos (2-chloro-1-(2,4,5-trichlorophenyl) vinyl dimethyl
phosphate), terbutryn (2-tert-butylamino-4-ethylamino-6-methylthio-s-
triazine), and etridiazole (5-ethoxy-3-(trichloromethyl)-1,2,4-thiadiazole)
in or on certain raw agricultural commodities (RAC's). EPA is initiating
this action because there are no current registrations associated with
these food uses. The applicable registrations for these pesticide uses
have been cancelled for nonpayment of maintenance fees and/or by company
request.

PESTICIDE TOLERANCES FOR TEFLUTHRIN (FORCE) PROPOSED
This document proposes to extend tolerances for the combined residues of
the synthetic pyrethroid tefluthrin [2,3,5,6-tetrafluoro-4-
methylphenyl)methyl-(1 alpha, 3 alpha)-(Z)-(+/-)-3-(2-chloro-3,3,3-
trifluoro-1-propenyl)-2,2-dimethylcyclo-propane caboxylate] and its
metabolite, (Z)-3-(2-chloro-3,3,3-trifluoro-1-propenyl)2,2-
dimethylcyclopropane-caboxylic acid, in or on the raw agricultural
commodities corn, grain, field, and pop; corn, forage and fodder,
field and pop. This proposal to extend the effective date for tolerances
for maximum permissible levels of residues of this insecticide in or on
these commodities was requested by Zeneca Ag Products (previously, ICI
Americas, Inc.).

revocation of the section 409 food additive regulations established under
the Federal Food, Drug and Cosmetic Act (FFDCA) for propargite on raisins
and dry grape pomace. The petitioner also requests that EPA not pursue a
section 409 food additive regulation for propargite in raisin waste. This
notice sets forth the basis for the petitioner's proposal and provides
opportunity for public comment.

parent, in or on the raw agricultural commodities (RACs) wheat straw,
barley straw, and oat straw at 0.2 part per million (ppm). This rule to
establish maximum permissible levels of combined residues of the pesticide
and certain of its metabolites in or on the commodities was requested by
Miles, Inc.

million (ppm); barley and wheat straw at 2.0 ppm; barley and wheat forage
at 5.0 ppm; meat, fat and meat byproducts (excluding kidney) of cattle,
goats, hogs, horses, and sheep; kidney of cattle, goats, hogs, horses, and
sheep at 0.2 ppm; and milk at 0.02 ppm. The Agency has not completed the
regulatory assessment of its science findings; therefore, EPA is proposing
to extend these tolerances for 1 year. These tolerances, will expire on
March 13, 1996.

This document establishes a permanent tolerance for residues of the
fungicide procymidone, N-(3,5-dichlorophenyl)-1,2-dimethylcyclopropane-1,2-
dicarboximide, in or on the raw agricultural commodity (RAC) wine grapes at
5.0 parts per million (ppm). Sumitomo Chemical Co., Ltd., petitioned EPA
to establish this regulation setting the maximum permissible level for
residues of procymidone in or on wine grapes.

Xanthomonas campestris subsp. vesicatoria; ESTABLISHMENT OF TEMPORARY
EXEMPTION FROM TOLERANCE
EPA has established an exemption from the requirement of a tolerance for
bacteriophages isolated from Xanthomonas campestris subsp. vesicatoria in
or on the raw agricultural commodities tomatoes and peppers. This
exemption has been established by the Agency on its own initiative. This
temporary exemption expires August 15, 1996.

PERTHANE: REVOCATION OF TOLERANCES
This rule revokes tolerances for residues of the pesticide Perthane in or
on raw agricultural commodities because all registrations of Perthane have
been canceled. This regulation became effective September 30, 1994.
CALCIUM HYPOCHLORITE; PROPOSED EXEMPTION FROM TOLERANCE
EPA proposes to establish an exemption from the requirement of a tolerance
for residues of chlorine gas in or on grapes when applied as a fumigant
postharvest by means of a chlorine generator pad in accordance with good
agricultural practices. Chiquita Frupac requested this proposed expansion
of the tolerance exemption.

PSEUDOMONAS FLUORESCENS STRAIN NCIB 12089; EXEMPTION FROM THE
REQUIREMENT OF A TOLERANCE
This document establishes an exemption from the requirement of a tolerance
for residues of Pseudomonas fluorescens in or on the raw agricultural
commodity mushrooms. This exemption from the requirement of a tolerance
was requested in a petition submitted by the Interregional Research Project
No. 4 (IR-4).

DIFENOCONAZOLE (SCORE); PESTICIDE TOLERANCES
EPA is establishing tolerances for residues of the fungicide difenoconazole
(Score) in or on certain raw agricultural commodities. Ciba-Geigy Corp.
requested this regulation to establish the maximum permissible levels of
residues of the fungicide in or on the commodities.
Time-limited tolerances, to expire on December 31, 1998, are established
for difenoconazole, in or on the following raw agricultural commodities:
cattle, fat; cattle, meat; cattle, mbyp; goats, fat; goats, meat; goats,
mbyp; hogs, fat; hogs, meat; hogs, mbyp; horses, fat; horses, meat; horses,

This document revokes tolerance and feed additive regulations listed in 40

various raw agricultural commodities and in animal feeds. EPA is
initiating this action because registered uses of demeton have been
canceled

ALACHLOR (LASSO); REVOCATION OF CERTAIN TOLERANCES
This document revokes certain tolerances for residues of the herbicide
alachlor and its metabolites in or on various raw agricultural commodities.
EPA is initiating this action because registered uses of alachlor on
certain food commodities have been canceled.
EPA proposed to revoke tolerances established under section 408 of the
Federal Food, Drug, and Cosmetic Act (FFDCA), 21 U.S 346a, for residues
of the herbicide alachlor (2-chloro-2',6'-diethyl-N-
(methoxymethyl)acetanilide) and its metabolites in or on the following raw
agricultural commodities listed in 40 CFR 180.249: Cotton forage,
cottonseed, sunflower seed, pea forage, pea hay, peas with pods removed,
and potatoes.
By March 1988, the product registrations under the Federal Insecticide,
Fungicide, and Rodenticide Act (FIFRA), as amended, for the pesticide
products containing the herbicide alachlor were canceled for the above-
mentioned raw agricultural commodities. Based on the fact that alachlor is
no longer domestically registered for use on these food crops and a
tolerance is generally not necessary for a pesticide chemical which is not
registered for the particular food use, EPA now proposes to revoke the
tolerances listed in 40 CFR 180.249 for residues of alachlor in or on these
commodities. Since theproduct registrations were canceled more than 5
years ago, residues should not appear in any legally treated, domestically
produced or imported commodities. These tolerances were obtained in
conjunction with the FIFRA registrations.

BENOMYL AND TRIFLURALIN; REINSTATEMENT OF FOOD ADDITIVE REGULATIONS
By this document, EPA is implementing the Court's order by reinstating the
food additive regulations for benomyl and trifluralin pending judicial
review of EPA's June 1994 Order by that Court.
EPA is implementing the Court's Order granting a stay by reinstating the
benomyl (processed tomato products and raisins) and trifluralin (peppermint
and spearmint oil) food additive regulations pending judicial review of
EPA's decision. These regulations, therefore, will remain in place until
the stay is terminated, EPA is otherwise ordered by the District Circuit
Court of Appeals or another court, or EPA takes further administrative
action.
EPA is not reinstating the food additive regulations for mancozeb (bran of
wheat) and phosmet (cottonseed oil) because they were not the subject of
the Court's August 24, 1994 decision. Therefore, those regulations
continue to be revoked.

PESTICIDE TOLERANCE PETITIONS; FILINGS AND A WITHDRAWAL
EPA has received two pesticide petition filings and a request to withdraw a
food additive petition without prejudice to future filing as follows:
1. PP 4F4331. Monsanto Co., 700 Chesterfield Parkway North, St. Louis, MO
63198, has filed PP 4F4331 proposing to amend 40 CFR part 180 to establish
an exemption from the requirement of a tolerance for the plant pesticide
Bacillus thuringiensis var. kurstaki delta endotoxin protein as produced by
the CrylA(c) gene and its controlling sequences.
2. PP 8F3635. ATL Enterprises, Inc., 3601 Garden Brook, Dallas, TX 75234,
proposes to amend 40 CFR part 180 by establishing an exemption from the
requirement of a tolerance for Aqueous extract of roots, galls, and bark
from Opinta Lindhimer, Quercus Placata, Rhus Aromatica, and Rhizophoria
Mangle when used as a plant regulator in soil and/or foliar applications in
or on all raw agricultural commodities. This notice originally appeared in
the Federal Register of October 12, 1988 (53 FR 39783).
Withdrawal of Petition:
3. FAP 3H5679. In a notice issued in the Federal Register of October 21,
1993 (58 FR 54357), it was announced that Zeneca AG Products, P.O. Box 751,
Wilmington, DE 19897, had filed the food additive petition proposing to
amend 40 CFR part 185 to establish a food/feed additive regulation to
permit residues of the insecticide 1-alpha(S)-(#), 3-alpha(Z)-( #)-cyano(3-
phenoxyphenyl)methyl 3-(2-chloro-3,3,3-trifluoro-1-propenyl)-2,2-
dimethylcyclopropanecarboxylate (lambda-cyhalothhrin) for use in food-
handling establishments. Zeneca AG Products has notified EPA that it
requests that the petition be withdrawn without prejudice to future filing.

ISSUANCE OF EXPERIMENTAL USE PERMITS
EPA has granted experimental use permits to the following applicants.
These permits are in accordance with, and subject to, the provisions of 40

o-phenylphenol The Dow Chemical Company plans to delete apples,
(Dowicide(R) cantaloupes, carrots, cherries, kumquats, pineapples,

to OPP) phenylphenol due reregistration costs. Unless
withdrawn by Dow, this
action becomes final on 9/13/94. Dow will defend the
uses of OPP on citrus crops and pears. The remaining
registered uses of OPP (i.e. cucumbers, kiwifruit,
nectarines, peaches, peppers, plums, prunes, and
tomatoes) will likely be canceled as the USEPA
completes a review of other registrants' OPP products.
Dealers and users may distribute, sell, and use
existing stocks of OPP until such stocks are depleted.

perfluidone PBI/Gordon Corporation plans to voluntarily cancel the
(Destun) use of perfluidone on tobacco due to the cost of
reregistration. This is the last registered use of
this herbicide; it has not been marketed in the U.S.
for several years. Unless withdrawn by the registrant,
this cancellation becomes final on 10/18/94. PBI/Gordon
will consider continuing this use if another party wishes
to develop the required data. If cancelled, existing
stocks of perfluidone in the hands of dealers and users can
be distributed, sold or used until such stocks are
depleted.

(Lasso)
The USEPA has revoked the tolerances for residues of
alachlor on or in cotton forage, cottonseed, sunflower
seed, pea forage, pea hay, peas with the pods removed,
and potatoes as of 8/3/94. Product containing
registrations for these uses were canceled by March,
1988. Several other registered uses and tolerances for
alachlor are unaffected by this decision. The proposal
for the revoked uses was published here on 2/16/94;
the USEPA did not receive any public comments to this
proposal. The USEPA is not recommending action levels
to replace the revoked tolerances.

etridiazole The USEPA has proposed the revocation of the tolerance
(Terrazole) for residues of etridiazole in or on tomatoes. This
fungicide was last registered on tomatoes in the mid
1980's. Several tolerances and registrations for
etridiazole on other crops remain unaffected by this
decision. The USEPA does not plan to recommend an
action level to replace the tolerance for etridiazole on
tomatoes due to the historically low level of residue
detection and the length of time since the underlying
use was registered.
terbutryn The USEPA has proposed the revocation of all tolerances
(Igran) for residues of terbutryn on or in barley, sorghum, and
wheat. This herbicide was last registered in 1989. The
USEPA does not plan to recommend action levels to
replace the tolerances for terbutryn due to the
historically low level of residue detection (no
detection in recent years) and the length of time since
the underlying uses were registered.
tetrachlorvinphos The USEPA has proposed the revocation of tolerances for
(Rabon) residues of tetrachlorvinphos on or in apples, cherries,
corn, cranberries, peaches, pears, and tomatoes.
Products with these registered uses for this insecti-
cide were registered in 1987.Tetrachlorvinphos is still
last registered for a variety of livestock uses. The
USEPA does not plan to recommend action levels to
replace the tolerances it plans to revoke
due to the historically low level of residue
detection (no detection in recent years) and the length
of time since the underlying uses were registered.
