Section 408(b)(2)(B) Benefits - Tolerances for "Eligible" Pesticide Residues

Elimination of automatic benefits consideration

  • In setting tolerances under the prior law, EPA was required to consider benefit-related factors, including the necessity for production of an adequate, wholesome and economical food supply, and USDA's opinion of the usefulness of the pesticide. In the new law, these benefit-related provisions have been deleted.
