Section 408(l): Harmonization with Action under Other Laws

The Administrator may not unnecessarily destroy lawfully treated food already in the pipeline.

  • Despite the suspension or cancellation of a pesticide registration and its associated tolerance or exemption, EPA cannot automatically declare a food unsafe solely because it contains the residue of such pesticide. If the residue resulted from a lawful application and falls within the prior tolerance, EPA can declare such food unsafe only if it is determined that its consumption "will pose unreasonable dietary risk".
