A pesticide ... (1) intended to reduce or mitigate the growth or development of microbial organisms ... and (2) exempt from a tolerance under Section 408 of the FFDCA.

Does not include liquid chemical sterilant products for use on critical or semi-critical medical devices -- subject to FDA jurisdiction
