Re: MaxCelTM Plant Growth Regulator Solution EPA Experimental Use Permit No. 73049-EUP-2

An Experimental Use Permit (EUP) is hereby issued for MaxCelTM Plant Growth Regulator Solution (EPA Experimental Use Permit No. 73049-EUP-2) to evaluate the product's efficacy when used as an apple fruit thinner and/or its effects when multiple low rates are applied for apple fruit sizing. MaxCel TM is a replacement label for VBC-30001 Plant Growth Regulator which was approved on March 12, 2003. The Certificate of Pesticide Registration and New York stamped "Accepted" labeling are enclosed for your files.

Shipment and/or use in New York State is subject to the following conditions:
  1. The approved New York State cooperator list (copy enclosed) is the list received on February 18, 2003, as an attachment to your electronic mail. Twelve (12) cooperators (six acres each) have been identified. You must notify this office at least five days prior to application if there are any changes/additions to the list of cooperators;

  2. MaxCelTM product labeling specifies "Do not exceed a total of 308 fluid ounces (182 grams 6BA) per acre per season for all uses." Based on the proposal to treat a total of 72 acres in New York State, the year 2003 and year 2004 experimental programs are limited to a maximum of 173.25 gallons VBC-30001 (13,033 grams 6BA) per year;

  3. It is your responsibility to notify appropriate Regional Office of the Department at least 48 hours prior to any treatment. Enclosed is a list of Regional Office contacts and phone numbers; and

  4. The federal EUP expires January 31, 2005. The State EUP is subject to renewal on June 30, 2005.
