Re:	Response to Your Inquiry Regarding the Registration of Roundup R-T-U Weed & Grass Killer
    Plus Weed Prevent (EPA Reg. No. 71995-21)

  The New York State Department of Environmental Conservation (Department) received your 
e-mail request to review the above-referenced label with regard to registration of this product
for general use in New York State. The product contains 0.03% of the active ingredient 
dithiopyr. New York State has 68 products registered which contain the active ingredient 
dithiopyr. All 68 products are applied via a broadcast method. The Department has allowed 
registration of products at a broadcast application rate of 0.50 lb. dithiopyr per acre per 
year as "restricted use only" commercial use products. Products that limit the application 
rate to 0.25 lb. per acre per year are not restricted and are labeled for general use by the 
homeowner.

  The Department has reviewed the Roundup R-T-U Weed & Grass Killer Plus Weed Prevent 
(EPA Reg. No. 71995-21) label that was sent to the Pesticide Product Registration Section 
(PPRS) mailbox on 02/11/03. We are in agreement that the labeled use of this product is for 
spot treatment. Although the rate of dithiopyr applied would be 0.371b. per acre per year, 
assuming the worst case broadcast application, the combination of active ingredients glyphosate 
isopropylamine salt and dithiopyr would prevent any homeowner from applying it in this manner. 
Therefore, the Department will process your product application for registration in New York 
State, waiving the New York State specific requirements for registration of a product 
containing dithiopyr.

  Please note that a proposal by Monsanto or any other registrant to register a product that 
contains dithiopyr for a homeowner spot treatment application will be reviewed on a 
case-by-case basis.

  Please be aware that any unregistered product may not be sold, offered for sale, distributed,
or used in New York State.
