flumetsulam (Broadstrike) NYSDEC Denial of Addendum to EUP 5/94

Mr. Steve A. McMaster
Manager, State Regulatory Affairs
DowElanco

Dear Mr. McMaster:
Addendum to Experimental Use Permits Containing
Flumetsulam (Broadstrike);
Broadstrike + Treflan (soybeans) (EPA Reg. No. 62719-EUP-17)
Broadstrike + Dual (soybeans) (EPA Reg. No. 62719-EUP-22)
Broadstrike + Dual (corn) (EPA Reg. No. 62719-EUP-23)
The New York State Department of Environmental Conservation
has reviewed your request, received April 19, 1994, for an
increase in acreage to a total of 300 acres for the above three
experimental use permits. We feel that the acreage specified in
the original experimental use permits, issued June 6, 1993,
should be sufficient to obtain any further data needed at this
time by DowElanco.
The original experimental use permits specified:
Broadstrike + Treflan (soybeans) (EPA Reg. No. 62719-EUP-17)
to be used on 7 acres in 1994, expires 9/4/94
Broadstrike + Dual (soybeans) (EPA Reg. No. 62719-EUP-22)
to be used on 10 acres in 1994, expires 9/4/94
Broadstrike + Dual (corn) (EPA Reg. No. 62719-EUP-23)
to be used on 25 acres in 1994, expires 2/25/95
The purpose of an experimental use permit is to allow the
registrant an opportunity to generate additional technical data
in support of the Section 3 registration. As you are aware the
Section 3 registration for Broadstrike (flumetsulam) was granted
to DowElanco on October 20, 1993. Therefore, additional research
data is not required.
The present acreage indicated in the three experimental use
permits (EPA Reg. No. 62719-EUP-17, 22, 23) is sufficient to
allow DowElanco to continue trial runs in New York State.
The Department is concurrently reviewing your application to
register flumetsulam as a new active ingredient in New York
State. A registration decision will be issued by the Department
on or before September 30, 1994.
DowElanco must submit revised lists of cooperators and
corresponding acreage, which reflect the acreage originally
accepted by EPA and which is outlined above, to the Department
within fifteen (15) calendar days of receipt of this letter.
Failure to submit the requested lists will result in cancellation
of the experimental use permits.
If you have any questions, contact Ms. Maureen Serafini, of
my staff, at (518) 457-7446.
