Dear Ms. Loft:
Re: Incomplete Application to Register One New Pesticide Product Containing the Active
Ingredient: lambda-cyhalothrin
The New York State Department of Environmental Conservation (Department) has completed a
second review of your application received on November 15, 2001, for Spectracide Triazicide
Brand Soil & Turf Insect Killer Granules (EPA Reg. No. 9688-181-8845). The Department is
grouping this application with your application that was received on January 8, 2002, for
the registration of Spectracide Triazicide Brand Soil & Turf Insect Killer Concentrate
(EPA Reg. No. 9688-183-8845) in New York State. The applications were submitted as "routine"
initial registrations of a pesticide product. However, these products are labeled for homeowner
use as a soil and turf insect killer. New York State has not registered a product which
contains the active ingredient lambda-cyhalothrin for homeowner use. This change in use
pattern for homeowner use is considered a major change in labeled use pattern in New York
State.
According to 6 NYCRR 326.15(a)(2), (b) and 326.17, applications for pesticide product
registrations containing a major change in labeling must be clearly identified as such and
must contain additional information. Therefore, your applications for the registration of
Spectracide Triazicide Brand Soil & Turf Insect Killer Granules (EPA Reg. No. 9688-181-8845)
and Spectracide Triazicide Brand Soil & Turf Insect Killer Concentrate (EPA Reg. No.
9688-183-8845) are incomplete:
The documents necessary to support registration of a major change in labeling are specified
in the "New York State Pesticide Product Registration Procedures Manual" dated August 1996,
Appendix 1; section B. A copy of this document is available at the Department's website at:
http://www.dec.state.ny.us/website/dshm/pesticid/pesticid.htm
The above-mentioned information will be necessary to continue the review of the
above-referenced application package. Spectrum Group, Div. of United Industries Corp. must
submit the required information to this office within 45 calendar days of receipt of the
Department's letter dated 02/19/02. Failure to submit the requested information within the
designated time frame will result in the termination of the review process.
Please note that if you wish to reapply for registration after the specified 45-day deadline,
you must submit the requested information along with new application forms and fees.
Please be aware that any unregistered product may not be sold, offered for sale, distributed,
or used in New York State.
