Re: Denial of Application to Register Two New Pesticide Products, Spectracide Triazicide
Brand Soil & Turf Insect Killer Concentrate (EPA Reg. No. 9688-183-8845) and Spectracide
Triazicide Brand Soil & Turf Insect Killer Granules (EPA Ref. No. 9688-181-8845)
The Department, on February 19, 2002 and March 7, 2002, sent you letters (copies enclosed)
stating that your application to register the above-mentioned pesticide products were
incomplete. The products contain the active ingredient lambda-cyhalothrin with homeowner
use on vegetables and/or soil and turf which is considered a major change in labeling for
New York State.
The letters, dated February 19, 2002 and March 7, 2002, deemed your applications
administratively incomplete and outlined the information necessary to be submitted in
order to continue the review of the above-referenced application packages. The required
information was to be submitted to this office within 45 calendar days of receipt of the
letters or the review process for the application would be terminated. To date (45 calendar
days from the Department's receipt of the "Certified Mail Return Receipt" green card), no
additional information has been received by the Department. Therefore, your applications to
register Spectracide Triazicide Brand Soil & Turf Insect Killer Concentrate (EPA Reg. No.
9688-183-8845) and Spectracide Triazicide Brand Soil & Turf Insect Killer Granules (EPA Reg.
No. 9688-181-8845) is denied.
If you wish to pursue registration of the above-listed products, you will be required to submit
a new application with all required documentation and fees, or pursue the options available
under Article 33-0711 of the New York State Environmental Conservation Law. A copy of this
and other documents are available at the Department's website at the address listed in our
letterhead.
Please be aware that any unregistered product may not be sold, offered for sale, distributed,
or used in New York State.
