Re: Diazinon Registrations in New York State

The New York State Department of Environmental Conservation (Department) has reviewed your request, dated March 13, 2003, regarding the continued registration of diazinon products in New York State.

The Department intends to follow the provisions for outdoor non-agricultural uses (home lawn, garden, and any other outdoor residential or outdoor non-agricultural uses) outlined in the agreement with diazinon registrants which specifies the following: o Stop formulation of products as of June 30, 2003. Stop sale to retailers as of August 31, 2003. Cancellation of product registrations, with no provision for existing stocks, as of December 31, 2004.

Technical registrants have agreed to buy back existing products from retailers commencing December 31, 2004.

The Department will review its files and determine which products may not be sold by retailers after December 31, 2004 and suspend those registrations. If the unregistered products are found in the channels of trade, enforcement action will be taken.
