Dear Mr. Krygsman:

Re: Acknowledge Request to Withdraw Application To Register Termidor 80 WG
    (EPA Reg. No. 432-900) & Termidor SC (EPA Reg. No. 432-901) containing the active
    ingredient Fipronil.

  The New York State Department of Environmental Conservation (The Department) has received
your letter, dated January 25, 2001 requesting the withdrawal of your application to register
the two products listed above. The Department received your application and data package on
October 5, 2000, requesting registration of the above referenced products. These two products
are labeled for use as a termiticide-insecticide for pre- and post construction treatment to
prevent structural damage from termite infestation. The products are applied as a curtain
treatment by rodding or trenching around the structure. Due to the nature of rodding and/or
trenching with application of the product, the Department considered the application(s) to be
a major change in labeled use pattern(MCL) for the active ingredient, fipronil, in New York
State.

  The Department acknowledges Aventis's request to withdraw the applications to register
Termidor 80 WG (EPA Reg. No. 432-900) & Termidor SC (EPA Reg. No. 432-901) submitted as
an MCL. Please be aware that by withdrawing the above listed applications, Aventis forfeits
the $300/product application fee and that any subsequent application for registration of
these products will require submittal of a complete application and fee.

  Also, please be aware that any unregistered product may not be sold, offered for sale,
distributed, or used in New York State.
