  Enclosed is the latest notice of the Reregistration Notification Network
 
  (RNN) dated April 8, 1994.  This notification contains an extensive list of
 
  residue tolerances potentially affected by the new interpretation of the
 
  Delaney Clause.  The registered uses causing these residues may eventually
 
  be canceled.  We'll keep you informed of any changes in or the
 
  implementation of this list.

The intent of this network is to inform interested parties of recent or
impending pesticide use cancellations, tolerance revocations, and other items
of agricultural interest.  To the best of our knowledge, the uses mentioned
here, unless otherwise indicated, will not appear on any label registered by
the USEPA after those uses are canceled.  We recommend that you express any
concerns or questions you have to the contact mentioned below or to your

The USEPA has published an updated list of pesticide residue tolerances
potentially affected by the Delaney Clause in Section 409 of the Federal
Food, Drug and Cosmetic Act (FFDCA).  This action has been taken because the
Ninth Circuit Court of Appeals has ruled that the Delaney Clause bars
tolerances for carcinogenic pesticides in processed food without regard to
the degree of risk.  This is the updated list of those residue tolerances
that will likely be revoked by the USEPA because of this new interpretation
of the Delaney Clause; the registered uses causing these residues will likely
be canceled.  This list was first published in February of 1993.  This
updated list includes three new pesticides and over 20 new uses.
