FIFRA Section 18: Emergency Exemptions
Under the authority of § 18 of FIFRA, U.S. EPA at their discretion, may exempt any Federal or State agency from any provision of FIFRA, if they determine that an emergency condition exist, which requires such exemption.
Definition of "Emergency Condition"
40 CFR § 166.3(d) defines an emergency condition as an urgent, non-routine situation that requires the use of a pesticide(s). An emergency condition exists only when the situation is urgent and non-routine and all three conditions are met:
